Previously, the start of construction without notifying the management agency was only fined 500,000 VND to 1 million VND, now it will be fined from 5-10 million VND. In addition, at the time of starting construction without drawings or construction permits, a fine of 60-80 million VND will be imposed.

FORTUNE HONORS VIETTEL CONSTRUCTION IN THE TOP 500 LARGEST COMPANIES IN SOUTHEAST ASIA

Recently, the famous Fortune magazine announced the Top 500 largest companies in Southeast Asia in 57 fields, based on revenue criteria for the fiscal year 2023.


At the end of January, the Government issued Decree No. 16/2022/ND-CP stipulating penalties for administrative violations in construction. In particular, Article 15 of this Decree has increased the fine levels related to starting construction of works.

Specifically, the following acts will be fined from 5-10 million VND:

– Không gửi văn bản thông báo ngày khởi công (kèm theo bản sao giấy phép xây dựng, hồ sơ thiết kế xây dựng) cho cơ quan quản lý nhà nước về xây dựng tại địa phương nơi xây dựng công trình và cơ quan chuyên môn về xây dựng theo quy định;

– Failure to notify or notify late to the local state management agency in charge of construction of the time of construction commencement, or notify but fail to enclose the construction design dossier as prescribed, for cases where construction is approved. exemption from construction permits;

– Do not send reports to specialized construction agencies or send incomplete reports on one of the following contents: name, contact address, project name, construction location, construction scale, construction progress expected work after starting construction or sending a notice of commencement not according to the prescribed form.

This fine is 10 times higher than the previous Decree 139/2017/ND-CP, only 500,000 VND – 1 million VND.


Also in Article 15, the start of construction when there is a lack of space, a lack of construction contracts, a lack of measures to ensure safety and protect the environment is also increased, to VND 30-50 million while the previous regulation was VND 30-50 million. fined 15-20 million dong.

For acts of starting construction without drawings, the old decree also fined 15-20 million dong, but in the new decree it was separated, to raise the fine to 60-80 million dong.

For acts of starting the construction of separate houses without a construction permit, the old decree has imposed a fine of 20-30 million VND, but the new decree has raised it to 60-80 million VND.

Decree No. 16/2022/ND-CP takes effect from January 28, 2022. có hiệu lực từ ngày 28/1/2022.
